A commercial dispute (arbitrazhny spor) is a dispute heard by an arbitration court (arbitrazhny sud) under the Code of Commercial Procedure of the Russian Federation (APK RF), arising from entrepreneurial or other economic activity. The parties are legal entities and individual entrepreneurs (IP), as well as government authorities and local self-government bodies.
How Arbitration Courts Differ from Courts of General Jurisdiction
The key distinction is subject matter: arbitration courts hear economic disputes, not ordinary civil matters (a debt between neighbors would not be heard there).
Arbitration proceedings presuppose that the parties are professional business actors, not private individuals. This is the “premier league” of litigation, with its own professional language and evidentiary standards.
Five key differences from civil courts:
| Parameter | Arbitration Court | Court of General Jurisdiction |
|---|---|---|
| Nature of disputes | Entrepreneurial and economic | Including personal/household |
| Service of documents | Parties serve each other | Court serves the parties |
| Summary judgment order | Up to 400,000 ₽ | Up to 500,000 ₽ |
| Technology | ”My Arbitrator” system, videoconference | Less advanced |
| Professional standard | High | Variable |
How Representation Works
We handle matters in four phases:
1. Preparation — reviewing documents, evaluating prospects, determining jurisdiction, calculating the state duty (gosposhlina).
2. Filing — assembling a complete document package and submitting it electronically through the “My Arbitrator” (Moy Arbitr) system.
3. Active representation — monitoring the case, attending hearings, keeping the client promptly informed.
4. Enforcement — tracking the deadline for the judgment to take effect, coordinating with banks and the Federal Bailiff Service (Federalnaya Sluzhba Sudebnykh Pristavov).
Why You Should Retain a Professional
Arbitration proceedings do not forgive procedural errors or missed deadlines. At the same time, all legal representation costs are recoverable from the losing party — a skilled attorney effectively costs nothing if the case is won.
An additional advantage: specialists based in Chelyabinsk can effectively represent clients before courts throughout Russia via videoconference — without the expense of travel.
