Legal Basis
Federal Law No. 135-FZ “On Valuation Activities” permits challenge of the cadastral value through:
- A specialized commission at the Federal Service for State Registration, Cadastre and Cartography (Rosreestr) — an out-of-court procedure
- Court proceedings (an arbitration court for organizations and sole proprietors; a court of general jurisdiction for individuals)
The basis for a review is the establishment of the market value of the property as of the date on which the cadastral value was determined.
Who May Challenge the Valuation
Any person whose rights and obligations are affected by the results of the cadastral assessment:
- Individuals — owners and lessees
- Organizations — including lessees of state and municipal land
Procedure
Through the Commission:
- Obtain an appraisal report on market value from a licensed appraiser
- File an application with the appraisal report at the Rosreestr Commission
- The Commission reviews the application within 1 month
- Upon a favorable decision, the revised cadastral value takes effect as of January 1 of the year in which the application was filed
Through Court: When challenging the Commission’s decision or filing directly with the court, an administrative statement of claim is submitted. The judicial route takes longer but allows recovery of court costs and appraisal fees from the respondent.
Recovery of Overpaid Taxes
After a successful reduction in cadastral value, an application may be filed for a recalculation of land tax and a refund of overpayments for prior periods — within the applicable statute of limitations.
