How to Recover a Debt from a Foreign National in a Russian Court
International Treaties and Jurisdiction
Applicable law and the enforceability of a court judgment depend on the international agreements between Russia and the foreign national’s country. A list of legal assistance treaties providing for mutual recognition of court decisions is available on the website of the Ministry of Justice of the Russian Federation.
Jurisdiction: under the Civil Procedure Code of the Russian Federation (GPK RF), cases involving foreign nationals are generally heard by the court at their place of residence or location in Russia.
Interpreter
Under Federal Constitutional Law No. 1-FKZ of 1996, court proceedings are conducted in the Russian language. Article 9 of the GPK RF guarantees the right of all parties who do not command the language to use the services of an interpreter. The costs of interpretation are borne by the losing party.
Enforcement of the Judgment
While the foreign national remains in Russia, enforcement is standard: a court order (sudebny prikaz), bailiffs, and account seizures. If the debtor has departed, enforcement becomes more complex: a Russian court judgment has no jurisdiction abroad. To enforce it in another country, recognition must be obtained under an applicable legal assistance treaty.

Choosing the Court
- Civil disputes (against individuals) — court of general jurisdiction (sud obshchey yurisdiktsii)
- Commercial disputes (against legal entities and sole proprietors) — arbitration court (arbitrazhny sud)
Territorial jurisdiction is determined by the place of registration of the respondent. A company’s address can be verified through the Unified State Register of Legal Entities (EGRYUL) on the FNS website. An individual’s address is confidential, but a statement of claim may be filed at the last known address — the court will make its own inquiry.
State Duty (Gosposhlina)
Applicable rates are found in the Tax Code; payment details are available on the website of the relevant court. When paying at a bank, a foreign national presents their passport. The receipt is attached to the statement of claim.
The Proceedings
Russian civil procedure is adversarial: each party independently gathers and presents its evidence. A foreign national may participate in person or through a representative — an attorney (advokat) or a person with a higher legal education.
Enforcement of the Judgment
Once the judgment takes effect (generally 30 days after issuance, if no appeal is filed), the court issues a writ of execution (ispolnitelny list). This is presented to the debtor’s bank or to the Federal Bailiff Service. If the debtor is deliberately concealing assets or attempting to move funds abroad, immediate action is essential — foreign nationals often assume that Russian court judgments will not follow them.
